4. Bookings and Reservations

4.1 Booking Process

All villa listings displayed on the Site are subject to availability. Submitting a booking request does not guarantee a reservation until you receive a confirmation email or booking confirmation from SeaSky Villas.

4.2 Pricing and Payment

• All prices are listed in ZAR, South African Rands and are subject to change without notice until a booking is confirmed
• A deposit or full payment may be required at the time of booking, as specified during checkout
• Additional fees (cleaning fees, security deposits, taxes, service charges) may apply and will be disclosed prior to booking confirmation
• Payment must be made through the methods specified on the Site

4.3 Booking Terms / Conduct Agreement

Booking Terms / Conduct Agreement vary by property and will be clearly stated on the individual listing at the time of booking. Please review before confirming your reservation.

5. Guest Responsibilities

By booking a property through SeaSky Villas, you agree to:

• Provide accurate guest information and comply with any maximum occupancy limits
• Treat the property, its furnishings, and surrounding premises with reasonable care
• Comply with any house rules provided by the property owner or manager
• Refrain from illegal activity, subletting, or hosting events not authorized in the listing
• Report any damage or issues to SeaSky Villas or the property manager promptly
• Vacate the property by the specified check-out time

6. Property Listings and Accuracy

We strive to ensure that property descriptions, photographs, amenities, and pricing information are accurate and up to date. However, SeaSky Villas does not guarantee that all listing content is error-free. We encourage guests to contact us with questions prior to booking.

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, videos, and software — is the property of SeaSky Villas Rentals or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

8. User-Generated Content

If the Site allows you to submit reviews, comments, or other content (“User Content”), you grant SeaSky Villas a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display such User Content in connection with the Services. You represent that your User Content is accurate, does not infringe on third-party rights, and is not defamatory, obscene, or unlawful. We reserve the right to remove any User Content at our discretion.

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SEASKY VILLAS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SEASKY VILLAS RENTALS, ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY BOOKED PROPERTY, INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE, PERSONAL INJURY, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE APPLICABLE BOOKING.

13. Indemnification

You agree to indemnify, defend, and hold harmless SeaSky Villas Rentals and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

14. Travel Insurance and Risk

Guests are strongly encouraged to obtain appropriate travel insurance to cover trip cancellations, medical emergencies, and property-related incidents. SeaSky Villas is not responsible for losses arising from travel disruptions, natural disasters, or events beyond our reasonable control (see Force Majeure below).

15. Force Majeure

SeaSky Villas shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, extreme weather, pandemics, government actions, or other events of force majeure.
